Not all divorces require one spouse to pay spousal support to the other. If there is a significant income disparity between the couple and they have been married for a long time, the chances of one paying the other spousal support are great.
The family court judge retains jurisdiction over the spousal support issue. If a judge issues an order for permanent maintenance, there is no expiration date on this obligation. It will continue until one of the parties dies or if the spouse receiving the money remarries or if there is a substantial change of circumstances.
Temporary maintenance can be ordered while the divorce is in process. It continues until the divorce decree is entered. Temporary spousal support can also be ordered while one spouse is attending school or working toward a new job. In addition, it can be paid if the marriage was short.
