A Waiver of Service comes into effect at the beginning of a divorce case. It removes the need for a private process server to present you or your spouse with the Original Petition for Divorce at home or on the job.
You are under no obligation to sign a Waiver of Service and if you decline to sign this document, your spouse will have to find another means to serve you with divorce papers. However, signing it can speed up the divorce process and also save expenses associated with paying a private process server.
By not signing it, you may also waive your rights to receive other important documents down the road. When in doubt, consult with an experienced Orange County Divorce attorney who can answer all of your questions and advise you of your legal rights and best options.
