Spousal support rights

Not all women or men are entitled to spousal support after a divorce or separation although once upon a time, support was awarded because of the notion that the spouses are supposed to support each other throughout the marriage.

Spousal support is a payment from one spouse to another; it is paid for the purpose of maintaining the former spouse’s standard of living during the marriage.  It can be awarded when one spouse is untrained or has been out of the workforce for a long period of time, making it difficult for them to attain a job.

Once the divorce is finalized, either spouse can ask for post-marital support.  It is not something that is coming to you, but it can be granted depending on the circumstances of the divorce.  Once awarded, a spouse can be penalized for failing to pay; he or she can lose their driver’s license, receive contempt of court charges or even serve jail time.
