While your divorce is pending, your spouse may request temporary support – especially if he or she is not working or earning significantly less than you are.
Courts in Orange County use a spousal support guideline. The guideline basically states that the spouse who earns more will provide 40 percent of his or her net monthly income, reduced by one-half of the lesser earning spouse’s net monthly income.
At the trail, the judge will determine the final amount by factors set forth in the California Family Code. These factors include the length of the marriage, standard of living he or she is used to, if there are children involved, and if there are employment opportunities available to the spouse requesting support.
