Spousal support & Divorce

Protect yourself from possible financial disaster!

Spousal support is normally awarded so the recipient spouse can have some degree of financial independence.  He or she can continue with the lifestyle they have been used to while the marriage was intact.  Depending on the circumstances, spousal support can be awarded for a limited time or indefinitely.

Temporary spousal support is usually awarded at an Order to Show Cause hearing.  It occurs when one spouse is earning significantly less than the other spouse or is unemployed. It is given while the divorce process is going on.  Permanent spousal support is only permanent in cases of very long marriages where the respective financial circumstances of the couple justify it.  This includes the length of the marriage, income of each party, ability of ex-spouse to become self-supporting, age of each party, etc.  It is given after the final judgment of Dissolution of Marriage takes place.
