I have been asked, “Does one person have to move out of the house when separating?”
With today’s economy being the way it is, it can be difficult financially to maintain two separate households while going through a separation or divorce. The courts tend to preserve the status quo when children are involved.
If you want to stay in the home after divorce, stay in it during the separation period. However, if you move out, be sure to have a written legal separation agreement made, which includes visitation terms, etc. A written agreement is critical for tax purposes also.
The separation period could be a complex matter. If you are planning on separating from your spouse in contemplation of divorce, contact an experienced Orange County Family Law attorney who will discuss your options and what is best for you and your children at this time.
