Your final divorce agreement says your spouse is responsible for paying the credit card debt. What happens if he or she doesn’t?
Even though there is a court order for your spouse to pay off certain debt, the account will remain in both of your names until there is a zero balance. A joint account means that both of you are responsible for any balances and if your spouse does not take care of this debt, your credit score may be affected.
Your best bet is to contact the credit companies and tell them what is happening in a written letter. Make sure you attach your divorce decree showing he or she is responsible for the debit.
If nothing is working, contact an experienced Orange County Family Law attorney who will advise you how to proceed and how to protect your credit.
