Domestic violence and child custody

Are you being abused by your spouse?  If so, it is hard not to feel angry and resentful.  Do you wonder why you have stayed with your spouse for this long?  Under California law, domestic violence is a crime that is taken very seriously.

California Family Code Section 6211 states, “Domestic violence is abuse perpetrated against specific categories of family members.” Statistics show that one out of four children is exposed to domestic violence.

When a couple separates, the court believes that the child should have the best relationship possible with both parents.  However, when domestic violence is involved, the court looks at other options because the best interests of the child are its number one priority. The court does not grant sole, joint legal or joint physical custody to a domestic violence perpetrator.
