Divorce and social security benefits

Many have asked the question, “Can I collect half of my former spouse’s social security after the divorce is final?”

The answer is maybe.  In order to do so, your marriage must have lasted for more than ten years and when you reach retirement age, you are not married to someone else.  If this is the case, you must provide your ex-spouse’s social security number and proof that you were married for at least ten year.  You do not need your ex-spouse’s permission and he won’t even be notified that you are collecting benefits based on his earnings.

The benefit is provided by Federal law.  If you are thinking about requesting benefits from your former spouse and have questions, contact an experienced Orange County Family Law attorney who can help you get through this process.
