In many divorce cases spousal support is ordered to ensure that the former spouse keeps the standard of living established during the marriage.
A problem arises if support hasn’t been paid in several months. The court does not stand for this and have made it almost impossible to get rid of arrears. Once arrears are owed, they must be paid off – even if you declare bankruptcy. There are ways to make sure payments continue which include taking it directly out of your paycheck, instituting a lien against your property or a contempt proceeding.
