A legal separation does not terminate the marriage. The couple retains their marital status even though their marriage has fallen apart. They choose to live apart.
The same issues as in a divorce process needs to be resolved and adjudicated. These issues include child custody, visitation and support, spousal support, division of property and the couple’s rights and obligations to each other. In certain cases, a legal separation is preferred because the parties retain medical insurance that would otherwise be lost in a divorce. Both parties must agree to a legal separation in order for it to be granted by the court.
