Do you need a temporary restraining order?

Many couples going through divorce face intense emotions and financial difficulties.  The divorce process can be a lengthy ordeal.  When domestic violence enters the picture, something must be done.  Even an allegation can have an immediate and detrimental effect on the alleged abuser’s freedom.

California takes a strict view of domestic abuse and proof of such violence comes with significant consequences.  Are you in physical danger of abuse from your spouse?   Do you fear that your children are in danger?  Or, have you been falsely accused of domestic abuse by a vengeful spouse?

If you have been abused or threatened with bodily harm, you can apply for a temporary restraining order.  If the judge orders one on your behalf, the alleged abuser can be forcibly removed from your home.  The court order lasts up to 30 days.  A more permanent order usually lasts for a year, but can be extended.
