California marriage licenses

The State of California issues two different types of marriage licenses. 

1.  A public marriage license requires the individual to be at least 18 years of age.  If he or she is not, they must get written consent from at least one parent or legal guardian.  In addition, permission from a California Superior Court Judge may be required.  The license can be obtained in any county and the couple is not required to be married in the same county.  Finally, the ceremony must be witnessed by at least one person.

2.  A confidential marriage license also requires the individual to be at least 18 years of age.  A minor is not allowed to purchase one.  The couple must sign an affidavit confirming that they are living together as spouses.  The marriage must take place in the same county that the license was obtained.  Finally, no witnesses are required.
