Who is responsible for taxes in a divorce?

Going through a divorce is stressful enough without having to worry about paying a joint tax bill.

It is important to bring up the matter of taxes during the divorce process; make sure the tax debt is separated at that time.  You need to learn what your options are for ensuring that you pay only your portion of whatever taxes are owed.

Once a joint tax return is filed, both parties are both jointly and separately responsible for the taxes owed.  If you are divorced, you are still jointly responsible for the IRS debt and the IRS reserves the right to take collection action against both of you.

If your divorce has become final since you filed your joint tax returns and you are responsible for your portion of the taxes owed and you do not know how to handle this, contact an experienced Orange County Family Law attorney who will assist you in making sure this is done properly.
