California domestic partnerships

A domestic partnership is a legal relationship available to same-sex couples.  It gives the couple the same rights, benefits, responsibilities, obligations and duties under the law as married spouses have.

According to California Family Code Section 297(a), “Domestic partners are two adults who have chosen to share one another’s lives in an intimate and committed relationship of mutual caring.”

A person who is at least 18 years of age can register as a domestic partner in the State of California.  However, if that person is under the age of 18, he or she must have written consent of the parents or guardian and a court order granting permission to establish a domestic partnership.  Once that is complete, a certified copy of the order must be filed with the California Secretary of State with a Declaration of Domestic Partnership filed out.
