What is a litigated divorce?

Divorce is not a one size fits all.  Every divorce is different.

Some couples agree amicably to get a divorce and work out the issues involved on their own.  They may even do their own paperwork or hire one attorney to prepare all the necessary documents.  This type of divorce is considered relatively fast and inexpensive.

However, there are many couples who cannot work things out on their own; they are not able to reach an agreement on parenting, support or property division.  They each need to hire an attorney to represent them in court – a litigated divorce begins.  Your attorney will work with you to determine your needs and best interests.  They will negotiate on your behalf.

Typically, the couple and their attorneys will attempt to reach an agreement while complying with court orders and deadlines.  If the couple is still unable to arrive at an agreement, they could ask the judge to conduct a trial and rule on the disputed issues.

If you cannot reach an acceptable agreement with your spouse, sometimes litigation is the only option available.  Contact an experienced Orange County Divorce attorney who will help you in attempting to resolve family matters amicably.
