Understanding a legal separation

Are you looking to separate from your spouse but not ready to commit to a divorce?  If so, it may be wise for you to look into a legal separation.

A legal separation allows you to live apart while it makes provisions for any children involved.  While you are still married, you are able to live alone and manage your own life.  The agreement allows you to determine certain issues that must be accomplished during the separation in order to minimize any conflict that may arise.  These include, but are not limited to:

·     Child custody and visitation

·     Child support and/or spousal support

·     Property and debt division

·     Filing taxes

·     Health insurance

While it may be difficult to come to an amicable agreement during this time, it can be extremely beneficial to make.  It is not always wise to jump into a divorce.  Filing for a legal separation gives you time to decide if living apart is the best plan for you.  A legal separation, in some cases, can be greatly advantageous to you.
